الشروط والأحكام الخاصة باستخدام تطبيق ROCKETCARGO لوساطة الشحن
المقدمة
نشكركم على استخدام تطبيق ROCKETCARGO لإدارة وتتبع الشحنات. يرجى قراءة هذه الشروط والأحكام بعناية قبل استخدام التطبيق. باستخدامك للتطبيق، فإنك توافق على الالتزام بكافة الشروط والأحكام التالية. في حالة عدم موافقتك على أي من هذه الشروط، يرجى عدم استخدام التطبيق.
1. التعريفات
التطبيق: هو منصة إلكترونية تتيح للمستخدمين ربطهم بشركات الشحن والخدمات اللوجستية لإتمام عمليات النقل والشحن، دون أن يكون التطبيق طرفًا مباشرًا في ملكية أو نقل الشحنات.
المستخدم/العميل: أي شخص طبيعي أو اعتباري يستخدم التطبيق لطلب خدمات الشحن.
شركة الشحن: الجهة المسؤولة عن استلام ونقل وتوصيل الشحنات.
الشحنة: البضائع أو الطرود التي يتم نقلها من نقطة إلى أخرى، سواء محليًا أو دوليًا.
2. استخدام التطبيق
يُقدم التطبيق للمستخدمين بهدف إنشاء الشحنات، اختيار شركة الشحن المناسبة، وتتبع حالة الشحنات.
يلتزم المستخدم بالامتثال لجميع القوانين واللوائح المحلية والدولية المعمول بها أثناء استخدام التطبيق.
يُحظر استخدام التطبيق لأي أغراض غير قانونية أو مخالفة للأخلاق العامة أو أنظمة النقل والشحن.
3. حساب المستخدم
قد يتطلب استخدام التطبيق إنشاء حساب شخصي. يجب على المستخدمين تقديم معلومات دقيقة وكاملة أثناء إنشاء الحساب.
يتحمل المستخدم مسؤولية الحفاظ على سرية بيانات حسابه وكلمة المرور، ويكون مسؤولًا عن أي نشاط يتم من خلال حسابه.
4. التزامات المستخدم
تقديم معلومات صحيحة ودقيقة عن الشحنات، بما في ذلك الوزن، الأبعاد، المحتوى، صور المحتوى والوجهة.
فى حالة عدم اضافة صور للشحنة فانة تنازل واضح عن حق من حقوقة لمطابقة محتوي الحشنة عند الاستلام
في حالة تاكيد استلام الحشنة من قبل المستلم لايجوز المطالبة بأي تعويض
الالتزام بعدم استخدام التطبيق في أنشطة غير قانونية أو تنتهك الأنظمة المعمول بها.
احترام سياسات شركات الشحن التي يتم التعامل معها عبر التطبيق.
5. دور التطبيق
يعمل التطبيق كوسيط إلكتروني بين المستخدم وشركة الشحن، مقابل رسوم إدارية قدرها 3٪ من قيمة كل شحنة، مع حد أدنى قدره 5 دراهم إماراتية لكل شحنة، سواء تم تنفيذ العملية أو تم إلغاؤها من قبل المستخدم.
لا يضمن التطبيق التزام شركات الشحن بأي شروط أو مواعيد أو جودة خدمة، ولا يتحمل أي مسؤولية عن أداء أو سلوك شركة الشحن.
لا يمتلك التطبيق الشحنات، ولا يتدخل في العمليات التشغيلية الخاصة بالنقل أو التسليم.
6. الشحنات والتسليم
يُتيح التطبيق تتبع حالة الشحنات والحصول على تحديثات فورية.
التطبيق غير مسؤول عن أي تأخير، تلف، فقدان، أو ضرر ينشأ أثناء النقل، حيث تقع المسؤولية الكاملة على شركة الشحن المختارة.
7. تعديل الشروط
يحتفظ التطبيق بالحق في تعديل هذه الشروط في أي وقت دون إشعار مسبق.
استمرار استخدام التطبيق بعد التعديلات يعني قبولك بالشروط الجديدة.
8. حدود المسؤولية
لا يتحمل التطبيق أي مسؤولية مباشرة أو غير مباشرة عن أي ضرر، فقدان، أو تأخير في تسليم الشحنات، أو أي نزاع ينشأ بين المستخدم وشركة الشحن.
جميع المعلومات المتعلقة بالشحنات (الوزن، الأبعاد، المحتويات، الوجهة) تقع على عاتق المستخدم.
يوفر التطبيق دعمًا فنيًا وخدمة عملاء على مدار 24 ساعة لتقديم المعلومات عن الشحنات، لكن أي مطالبة بالتعويض يجب تقديمها مباشرة إلى شركة الشحن المعنية.
9. إخلاء المسؤولية
يقر المستخدم بأن التطبيق غير مسؤول قانونيًا أو ماليًا عن أي خسائر أو أضرار ناتجة عن استخدام خدمات شركات الشحن المرتبطة بالتطبيق.
يتنازل المستخدم صراحة عن أي حق في مقاضاة التطبيق أو المطالبة بتعويض عن أي ضرر ناتج عن عمليات الشحن.
لا يتحمل التطبيق أي مسؤولية في حال تقديم معلومات خاطئة من قبل المستخدم أو شركة الشحن.
10. الخصوصية
تلتزم أدارة ROCKETCARGO بحماية خصوصية المستخدمين.
يتم جمع البيانات واستخدامها وفقًا لسياسة الخصوصية الخاصة بالتطبيق، والتي تشرح كيفية جمع البيانات، استخدامها، تخزينها، ومشاركتها مع أطراف ثالثة عند الضرورة.
11. القانون المعمول به والاختصاص القضائي
تخضع هذه الشروط لأحكام القانون الساري في الدولة التي يُدار فيها التطبيق.
تختص المحاكم المحلية في تلك الدولة بالفصل في أي نزاع ينشأ عن تفسير أو تنفيذ هذه الشروط.
12. سياسة التخزين والتغليف
التطبيق ليس مسؤولاً عن التخزين أو التغليف أو التلف، كل ذلك من مسؤولية شركات الشحن.
التطبيق يضمن فقط اختيار أفضل شركة، أفضل سعر، وأسرع خدمة.
أي رسوم تخزين إضافية أو تلف شحنة تقع على عاتق شركة الشحن.
13. شروط التخزين وانتهاء الصلاحية
مدة التخزين المسموح بها: 30 يومًا مدفوعة مسبقًا.
بعد انتهاء فترة التخزين، الشركة تحتفظ بحق تصنيف الشحنة كمفقودة أو فرض رسوم إضافية.
بعد 6 أشهر من وصول الشحنة، تحتفظ شركة الشحن بالحق في إعدام أو التخلص من الشحنة وفق سياستها والقوانين المحلية.

Terms and Conditions of Using ROCKETCARGO Shipping Brokerage App
Introduction
Thank you for using ROCKETCARGO to manage and track your shipments. Please read these Terms and Conditions carefully before using the app. By accessing or using the app, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must refrain from using the app.
1. Definitions
"App": The electronic platform that enables users to connect with shipping companies and logistics services for the purpose of shipment and transport, without the app being directly involved in ownership or physical handling of shipments.
"User/Customer": Any natural or legal person who uses the app to request shipping services.
"Shipping Company": The entity responsible for receiving, transporting, and delivering shipments.
"Shipment": Goods or parcels transported from one location to another, either locally or internationally.
2. Use of the App
The app is provided to users for the purpose of creating shipments, selecting the appropriate shipping company, and tracking shipments.
Users agree to comply with all applicable local and international laws and regulations while using the app.
The app must not be used for any illegal, fraudulent, or unethical activities.
3. User Account
Use of the app may require creating a personal account. Users must provide accurate and complete information during account registration.
Users are solely responsible for maintaining the confidentiality of their account information and password and for all activity that occurs under their account.
4. User Obligations
Users must provide truthful and accurate information regarding shipments, including weight, dimensions, contents, and destination.
Users must not use the app for any unlawful activity or in violation of any applicable regulations.
Users must adhere to the policies of the shipping companies engaged through the app.
5. Role of the App
The app acts solely as an electronic intermediary between the user and the shipping company, charging an administrative fee of 3% per shipment, with a minimum fee of AED 5 per shipment, whether the shipment is completed or canceled by the user.
The app does not guarantee that shipping companies will comply with schedules, service quality, or other commitments, and is not responsible for any performance or behavior of the shipping companies.
The app does not own shipments and does not intervene in the operational processes of shipping or delivery.
6. Shipments and Delivery
The app allows users to track shipment status and receive real-time updates.
The app is not responsible for any delay, damage, loss, or mishandling of shipments, as full responsibility lies with the selected shipping company.
7. Amendments to Terms
The app reserves the right to modify these Terms at any time without prior notice.
Continued use of the app after any modifications constitutes acceptance of the updated Terms.
8. Limitation of Liability
The app shall not be held liable for any direct or indirect damages, losses, or delays in shipment delivery, or any disputes arising between the user and the shipping company.
All shipment-related information (weight, dimensions, contents, destination) is the sole responsibility of the user.
The app provides technical support and customer service 24/7, offering all shipment-related information; however, any claims for compensation must be submitted directly to the relevant shipping company.
9. Disclaimer
Users acknowledge that the app is not legally or financially liable for any losses or damages arising from the use of services provided by shipping companies connected through the app.
Users expressly waive any right to sue the app or seek compensation for any damages resulting from shipment operations.
The app is not responsible for any false information provided by the user or the shipping company.
10. Privacy
ROCKETCARGO is committed to protecting users’ privacy.
Data collection, use, storage, and sharing are governed by our Privacy Policy, which explains how personal information is collected, used, and shared with third parties when necessary.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the country in which the app is operated.
The local courts of that country shall have exclusive jurisdiction over any disputes arising from the interpretation or enforcement of these Terms.
12.Storage & Packaging Policy
English: The app is not responsible for storage, packaging, or damage, which are the sole responsibility of shipping companies.
The app ensures only the selection of the best company, best price, and fastest service.
Any additional storage fees or damage are the responsibility of the shipping company.

English: Allowed storage duration: 30 days prepaid.
After the storage period, the company reserves the right to classify the shipment as lost or charge additional fees.
After 6 months from arrival, the shipping company reserves the right to dispose of or destroy the shipment according to its policy and local laws.
